Defending Drug Cases in Florida

Drug offenses are unique because they usually start by charging a crime for possessing an object.  This charge can be either "simple" possession or "trafficking" - the difference being only in the amount not in the act.  Simple possession, of marijuana for example, is the lowest charged criminal drug offense and trafficking is the highest charged criminal drug offense.  In between these two types of drug charges are a wide range of enhanced prohibited criminal drug acts: Possessing in certain areas like on school grounds; Distributing; Selling; Purchasing; Possessing with intent to distribute or sell; Cultivation or manufacturing.

The best time to consult with an attorney regarding drug charges is immediately after being arrested.  Very often an attorney can review the charging affidavit with the client and discuss possible defenses.  Drug offenses have more possible defenses than most other offenses.  Entering a plea to any drug offense without the advice of counsel is foolhardy.  Don't think that because it is just marijuana it is no big deal.

The DMV Suspension (Say "goodbye" to driving)

If convicted for possession of drugs, the suspension of a person's driver's license is two years.  The first six months are the "hardship" period - meaning no license to drive at all.  If someone gets caught driving on this suspension it will likely result in a jail term.  After six months and completion of a substance abuse course a person can apply for a "business purpose only" license that will allow him or her to drive for necessities only.  Let's keep you from losing this privilege!

Harsh Penalties for Drug Possession in Florida

They call marijuana or pot, cannabis.  The drug war is in full effect in the state of Florida.  We defend all drug charges including marijuana, cocaine, ecstasy, heroin, club drugs, etc.  Don't take drug charges lightly.  Florida suspends driver's licenses, fines, and jails people for drug possession charges.  Many times the State does not even have enough evidence to prove the case or has committed a Constitutional violation requiring suppression of all evidence.  There is no penalty for defending yourself according to the rules of criminal procedure in Florida.  If arrested - consult an attorney.  If you go to arraignment without an attorney plead NOT GUILTY and then contact us for a free consultation.

Enhanced Penalties

Political motives have created enhanced penalties for drug offenses.  Current minimum mandatory prison sentences and mandatory fines for certain possession offenses require everyone to take all drug charges seriously.  Very often a conviction for the simple possession of marijuana will entail penalties that include a year of probation (minus anytime spent/sentenced in jail), drug counseling that the defendant must pay for, community service, and, now, the Department of Highway Safety and Motor Vehicles is required to suspend the convicted driver's license for 2 years.  These possible penalties are, again, just for possession.

Constructive Possession
