TO PLEA "NOT GUILTY"
At the first appearance (if in jail) or the
arraignment the judge will determine if there is probable cause and advise you
of the pending charges. He or she may also ask you how you would like to
plea - the answer is always "Not Guilty." This is a legal
term and means you want additional time to decide what to do. By pleading not
guilty you will have time to seek advice from an attorney and determine what
Rights you have.
When talking with an attorney regarding representation,
always be honest and straight forward. Embellishing the facts to make your
case seem better is only self-defeating. Keep in mind that what you say to
an attorney regarding your case is confidential and privileged. Your
attorney is trying to help you and needs to know every bad fact as well as good
fact in order to develop a defense.
Know your rights. We all have the right to remain silent.
It is probably the most important right we have. Utilize it often. Whenever you are being questioned by a law enforcement officer about an offense
that they suspect you committed you should immediately stop talking and ask to speak to an attorney.
