Appellate Practice
Appeals are Time Sensitive - A notice of appeal must be filed within 30 days
of sentencing.
If you have been sentenced by the court because you were found guilty you
only have 30 days from the date of sentencing to file a Notice of Appeal.
If you fail to make that deadline, your right to appeal will, in most cases, be
considered waived.
Successful criminal appeals regularly require the hiring of an attorney that
understands the trial issues for that particular offense. Many times it is
more advantageous to hire an attorney other than the attorney that tried the
case. A different attorney will be able to review the issues objectively
and without entrenched biases. An experienced criminal trial attorney that
also possesses the skills necessary to pursue an appeal is often the best
choice.
Post-Conviction
Relief
Post-conviction relief encompasses all other forms of potential
higher court review of a conviction after an appeal. These forms of relief
have different time frames during which they can proceed. The rules
regarding these forms of review are complex and require an attorney skilled in
this area of law.
